In one paragraph. tended builds a website for your business and, if you choose, keeps it running for a monthly fee. You own your content and, once the build is paid for, the finished site. tended owns the tools it built the site with. Nothing is charged until you have approved the site and it is live on your address. tended does not promise rankings, traffic or sales, and its reports are opinions built from public data on the day they were made. The full terms below say the same thing in the detail that protects both of us.
1. Who this agreement is between
These terms are an agreement between you, the business or person using tended's services ("you"), and tended, a web studio based in Las Vegas, Nevada, operated by Jose Marquez Alberti ("tended", "we"). By creating an account, ordering a report, approving a build, or paying for a plan you accept these terms. If you are acting for a business, you confirm you have the authority to bind it.
2. What tended provides
- Free site report. A short automated read of your public website and Google listing, offered as information only.
- Full report. A paid, person-reviewed study of your listing, competitors, website, speed, search and AI visibility, with a written plan. Delivered as an unlisted web page.
- The build. A new website for your business, built from your existing public content and what you send us, presented at a private preview address for your review, then launched on your own domain once you approve it.
- Looked after (the monthly plan). Hosting, certificate, backups, edits you send, content kept in step with sources you connect, and a monthly report. Month to month.
- Systems work. Booking, ordering, quoting or store features, only when scoped and agreed in writing before work starts.
Anything not listed, such as hourly work, logo design, photography, advertising or social media, is not included unless agreed in writing.
3. Previews built before you ask
tended sometimes builds a preview of a business's website from information that business has already made public, and then offers it. A preview is unlisted, hidden from search engines, and creates no obligation on either side. Nothing on your current website, domain, accounts or systems is accessed or changed to make it. If you would rather a preview of your business did not exist, email us and it is deleted.
4. Your account and your responsibilities
- Keep your sign-in details private and tell us if you think someone else has used your account.
- Give us accurate information about your business, and tell us when it changes. Prices, hours, names and claims on your site are yours to confirm.
- Only send us content you have the right to use: text, photos, video, logos, product data. You are responsible for what your site says and sells, and for complying with the laws that apply to your business.
- Where the build connects to a third-party system (for example a store platform), any access you grant is limited to what the build needs, and you may revoke it at any time.
5. Ownership
- Your content is yours. You keep every right to the text, images, video, product data and brand you provide or that came from your existing site. You give tended a licence to copy, adapt and display that content only to build, host and maintain your site and to produce your reports.
- The finished site is yours once the build is paid. On full payment you receive the finished website as files: pages, images, styles and scripts that make it run. You may host it anywhere.
- tended's tools stay tended's. The build system, generators, templates, checks, code libraries, report methods and anything not specific to your business remain tended's property. The files you receive are yours to use; the system that made them is not transferred, and the deliverable is not a licence to reproduce that system.
- Your name. tended does not name you as a client, show your site as an example, or quote your results publicly without your written permission.
6. Payment
- The build is quoted before work is approved. It is charged only after the site is live on your domain and you have told us you are happy with it. It is then a completed sale and is not refunded.
- The monthly plan is billed in advance each month, by card through Stripe. Cancel at any time from your account or by email; the cancellation takes effect at the end of the paid month, with no refund for that month and no further charges.
- The full report is a one-time charge, due when ordered. Because it is produced and delivered specifically for you, it is not refunded once delivered. Its price is credited in full toward a build you approve within 90 days of the report date.
- Prices exclude any taxes that apply. If a payment fails, we tell you and try again; if it stays unpaid for 14 days the monthly plan may be paused.
- Payments are handled by Stripe. tended never sees or stores your card number.
7. Going live, and going back
Launch means pointing your domain at tended's server, usually two records in your domain account. You keep your domain and all your existing accounts. Old addresses are redirected to the new pages where they exist. If you want the old site back, the same two records are changed back; tended does not delete or alter anything you had before. You are responsible for the settings and bills of your domain registrar and any platform you continue to use.
8. If the monthly plan ends
When the plan ends, for any reason, tended keeps the site online for 30 days after the last paid period, provides the finished site as files on request, and then stops hosting it. Your domain will need to point somewhere else, which is your step to take. Content you uploaded is deleted from tended's systems within 90 days of the end of the plan unless the law requires otherwise.
9. No guarantees of results
tended works from measurements and does its best work for every client, but it cannot control Google, AI assistants, your market or your customers. tended does not promise search rankings, map-pack positions, mentions by AI assistants, traffic, calls, sales, or any business result. Speed scores and similar figures quoted by tended are lab measurements of a page on the day they were taken, using third-party tools whose methods change. Reports are tended's opinion built from public data on the date shown; they may contain errors from sources tended does not control, and they are not professional, legal or financial advice.
10. Third-party services
Your site may rely on services tended does not own: your domain registrar, store or booking platforms, payment processors, map and font providers, and the search engines and AI services that read your site. Their terms apply to you directly. tended is not responsible for their availability, changes, pricing or decisions, including a platform withdrawing an integration or a search engine changing how it ranks pages.
11. Acceptable use
You may not use tended's services for anything unlawful, deceptive or infringing, to send unsolicited bulk messages, to host malware, or to publish content you do not have the right to publish. tended may take a site offline where it reasonably believes the law or a third party's rights require it, and will tell you when it does.
12. Availability and support
tended aims to keep hosted sites online continuously and keeps daily backups, but does not promise uninterrupted service. Planned maintenance is done at low-traffic hours. Edits you send are made within the working days stated in your plan. Support is by email at hello@tended.site.
13. Disclaimer of warranties
Except as expressly stated in these terms, tended's services, sites, previews and reports are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the fullest extent the law allows.
14. Limit of liability
To the fullest extent the law allows, tended's total liability to you for any claim arising out of these terms or the services is limited to the amount you paid tended in the three months before the event giving rise to the claim. tended is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused. Some jurisdictions do not allow certain limits; in those places the limit applies as far as it is permitted.
15. Your indemnity
You agree to defend and hold tended harmless from claims, losses and reasonable legal costs that arise from the content you provide or approve, the products and services your business sells, your breach of these terms, or your violation of any law or third-party right.
16. Ending the agreement
You may stop at any time as described in sections 6 and 8. tended may end the agreement on 30 days' notice, or immediately if you breach these terms, fail to pay, or use the service in a way that exposes tended to legal risk. Sections 5, 9, 13, 14, 15 and 18 survive the end of the agreement.
17. Changes to these terms
tended may update these terms. The date at the top changes when it does, and clients on a monthly plan are told by email at least 14 days before a change that affects them takes effect. Continuing to use the service after that date means you accept the updated terms.
18. Governing law and disputes
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. If we have a dispute, we agree to try to resolve it by talking first: write to hello@tended.site and we will respond within 14 days. Any claim that cannot be resolved that way is brought in the state or federal courts located in Clark County, Nevada, and both sides consent to that venue. Nothing here limits either side's right to seek an injunction to protect its intellectual property.
19. The whole agreement
These terms, the privacy policy, and any written quote or scope you approve make up the whole agreement between us and replace earlier discussions. If any part is found unenforceable, the rest still applies. Neither side is liable for delay caused by events outside its reasonable control.
